These Terms of Use (“Terms”) outline your rights and responsibilities when using our Website and services — including AI receptionists, messaging automation, and digital assistant support across SMS, Instagram, Facebook, and web chat (collectively, the “Services”).
By accessing the Website, participating in a demo, or using our Services, you agree to these Terms. If you're accepting on behalf of a business, you confirm you're authorised to do so.
To use TruVital Digital, you must:
Be at least 18 years old.
Not be a competitor accessing our Services to copy, clone, or reverse-engineer
We may update these Terms occasionally. Continued use of the Services means you accept the latest version.
Some features may require account registration. You agree to provide accurate information and keep your login credentials secure.

You agree not to:
Violate any laws or regulations.
Harass, impersonate, or spam anyone.
Attempt to access systems or data you’re not authorised to.
Reverse-engineer our technology or AI models.
Upload viruses, malicious code, or disrupt the Services.
Use the Services in any unethical or disruptive way.
We are based in Australia and primarily serve Australian businesses. If you access our Services from elsewhere, you do so at your own risk and are responsible for local compliance.
Our standard service is offered at $197 AUD/month (billed separately from usage fees)
We offer a 14-day free trial (no credit card required)
After the trial, billing begins automatically unless cancelled beforehand
All payments are securely processed via third-party providers
Failed payments or payment method issues remain your responsibility
If you cancel partway through a billing cycle, the full monthly fee still applies — no partial refunds are offered
By subscribing, you agree that access to the platform is month-to-month, and no credits or refunds are issued for unused time if you opt out mid-month
We offer pay-as-you-go pricing for select services such as Voice AI, SMS replies, and other optional features.

Usage-based fees are billed separately from your monthly subscription and are calculated based on actual usage. These charges may appear as a separate line item or invoice.
Monthly payments cover a full 30-day period. No partial refunds are offered if you cancel mid-cycle. Cancelling prevents renewal at the end of the billing period.
We may monitor and analyse performance data (e.g., click tracking, reply rates) to improve your AI assistant.
We do not access your message content unless you request support. All assistant responses are generated based on new incoming messages only.
You retain ownership of your customer data. We only access or use this data to provide the Services or when support is explicitly requested.
When you first access your dashboard, you’ll be asked to securely connect your business’s Instagram and Facebook accounts through Meta’s login system. This allows your assistant to respond to new incoming messages on your behalf.
Your assistant:
Cannot access or respond to messages sent before the integration. Cannot see your posts, comments, or private content. Does not store login credentials. Only replies using the business profile, not your personal account.
You stay in control. We only access your account if you request setup or support.
All tools, branding, content, and tech we provide remain the intellectual property of TruVital Digital. You are granted a limited, non-transferable license to use our Services within your business.
By submitting content (e.g., service lists, branding info), you confirm that:
You own or have the right to use it. We can use it to personalise and improve your assistant. You remain responsible for its accuracy
Our Services are provided “as is.” While we aim for high reliability, we cannot guarantee uninterrupted or error-free performance.
Our AI-powered tools respond based on training and automation logic. While we strive for accuracy, we are not responsible for misinterpretations or errors resulting from automated AI-generated responses.
We are not liable for indirect, incidental, or consequential damages. Your sole remedy if dissatisfied is to stop using the Services.
We are also not liable for service delays due to causes beyond our reasonable control, including internet outages, platform disruptions, or regulatory changes.
You agree to indemnify TruVital Digital from any claims, costs, or damages resulting from misuse of the Services or breach of these Terms.
We may contact you via SMS or email for onboarding, demos, updates, or support. You may opt out at any time. Standard message rates may apply.
We respect your privacy. Your assistant:
Only replies to new incoming messages. Does not access prior message history Is fully visible and manageable by you via the LeadConnector app. Can be adjusted, paused, or removed at your request

We may suspend or terminate your access if you breach these Terms. You remain responsible for any charges up to that point.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in NSW courts.
Any claim related to these Terms must be brought within 12 months of the issue arising or will be considered waived.
No waiver: If we don’t enforce a term, we still retain that right
Severability: If one part is invalid, the rest remains enforceable
Entire Agreement: These Terms override previous versions or agreements
Assignment: You may not transfer your rights; we may do so as needed
