These Terms of Use (“Terms”) outline your rights and responsibilities when using our Website and services — including AI receptionists, messaging automation, and digital assistant support across SMS, Instagram, Facebook, and web chat (collectively, the “Services”).


Acceptance of Terms

By accessing the Website, participating in a demo, or using our Services, you agree to these Terms. If you're accepting on behalf of a business, you confirm you're authorised to do so.

 

👤 Who Can Use Our Services

To use TruVital Digital, you must:

Be at least 18 years old.

Not be a competitor accessing our Services to copy, clone, or reverse-engineer

🔄 Updates to These Terms

We may update these Terms occasionally. Continued use of the Services means you accept the latest version.

 

🔐 Accounts & Security

Some features may require account registration. You agree to provide accurate information and keep your login credentials secure.

🚫 What You Can’t Do

You agree not to:

Violate any laws or regulations.

Harass, impersonate, or spam anyone.

Attempt to access systems or data you’re not authorised to.

Reverse-engineer our technology or AI models.

Upload viruses, malicious code, or disrupt the Services.

Use the Services in any unethical or disruptive way.

 

🌍 International Access

We are based in Australia and primarily serve Australian businesses. If you access our Services from elsewhere, you do so at your own risk and are responsible for local compliance.

 

🔁 Subscriptions, Payments & Renewals

We offer flexible, no-lock-in monthly plans designed to help you stay on top of every lead — without hiring a receptionist.


🟢 Starter Plan – $197 AUD/month (incl. GST)

300 AI call minutes per month (inbound & outbound)

150 outbound SMS segments per month for customer communication

AI voice receptionist answers missed calls and sends job summaries

Free setup included (normally $800)

14-day free trial – no credit card required

If you’re nearing your usage limit, we’ll notify you and automatically upgrade you to the next plan

🔵 Growth Plan – $297 AUD/month (incl. GST)

Everything in the Starter Plan, plus:

600 AI call minutes per month

300 outbound SMS segments per month

Priority support and onboarding

Usage alerts and rollover handling


🔴 Unlimited Plan – $497 AUD/month (incl. GST)

Everything in the Growth Plan, plus:

Unlimited AI call minutes

Unlimited outbound SMS usage (Fair Use Policy applies)

Premium support and early access to new features

📌 Fair Use Policy
To keep your plan affordable and ensure reliable performance for all clients, “unlimited” usage is governed by a fair use threshold:

Up to 1,200 call minutes per month (inbound & outbound combined)

Up to 500 outbound SMS segments per month

Usage must reflect typical small business communications (e.g., leads, customers, inquiries)

Personal use, mass marketing, or call center activity may require a custom plan. We’ll notify you if your usage exceeds these limits.



📱 SMS & Email Usage

Each plan includes a set number of outbound SMS messages. These are used to contact customers — for things like quotes, scheduling, payment reminders, job updates, or appointment confirmations.

📏 1 SMS = up to 160 characters (including spaces)
📦 Longer messages may use 2 or more SMS credits, depending on content and formatting (e.g. links, emojis, punctuation).

➡️ Example:
A message with a long link or fancy punctuation may count as 2–3 SMS credits.

📊 All SMS messages — regardless of type — count toward your monthly usage.

📧 Emails are unlimited and included in every plan — use them freely for quotes, reminders, and follow-ups.


💳 Billing & Upgrades

Your 14-day free trial starts when your AI system is activated

Billing begins automatically unless cancelled before the trial ends

Payments are billed monthly in advance via secure third-party providers

If you exceed your usage, we’ll notify you and automatically upgrade your plan to match your activity

Your new rate applies on the next billing cycle


Failed Payments & Cancellations

You're responsible for keeping your payment method up to date

Failed payments may result in paused service

Cancelling mid-cycle ends access at the end of the paid period

No partial refunds or credits are issued for unused time


 

📊 Data Use & Service Optimisation

We may monitor and analyse performance data (e.g., click tracking, reply rates) to improve your AI assistant.

We do not access your message content unless you request support. All assistant responses are generated based on new incoming messages only.
You retain ownership of your customer data. We only access or use this data to provide the Services or when support is explicitly requested.

 

🔐 Social Media Integration & Privacy

When you first access your dashboard, you’ll be asked to securely connect your business’s Instagram and Facebook accounts through Meta’s login system. This allows your assistant to respond to new incoming messages on your behalf.

Your assistant: Cannot access or respond to messages sent before the integration. Cannot see your posts, comments, or private content. Does not store login credentials. Only replies using the business profile, not your personal account.

You stay in control. We only access your account if you request setup or support.

 

💡 Intellectual Property

All tools, branding, content, and tech we provide remain the intellectual property of TruVital Digital. You are granted a limited, non-transferable license to use our Services within your business.

 

📝 Content You Provide

By submitting content (e.g., service lists, branding info), you confirm that:

You own or have the right to use it. We can use it to personalise and improve your assistant. You remain responsible for its accuracy

 


⚠️ Disclaimer

Our Services are provided “as is.” While we aim for high reliability, we cannot guarantee uninterrupted or error-free performance.
Our AI-powered tools respond based on training and automation logic. While we strive for accuracy, we are not responsible for misinterpretations or errors resulting from automated AI-generated responses.

📉 Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Your sole remedy if dissatisfied is to stop using the Services.
We are also not liable for service delays due to causes beyond our reasonable control, including internet outages, platform disruptions, or regulatory changes.


🛡️ Indemnity

You agree to indemnify TruVital Digital from any claims, costs, or damages resulting from misuse of the Services or breach of these Terms.

 


📬 SMS & Email Communication

We may contact you via SMS or email for onboarding, demos, updates, or support. You may opt out at any time. Standard message rates may apply.

 

🔒 Privacy

We respect your privacy. Your assistant: Only replies to new incoming messages. Does not access prior message history Is fully visible and manageable by you via the LeadConnector app. Can be adjusted, paused, or removed at your request

Termination 

We may suspend or terminate your access if you breach these Terms. You remain responsible for any charges up to that point. 


 

⚖️ Governing Law 

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in NSW courts. 


 

Time Limit to Bring Claims 

Any claim related to these Terms must be brought within 12 months of the issue arising or will be considered waived. 


 

🧩 Miscellaneous

No waiver: If we don’t enforce a term, we still retain that right

Severability: If one part is invalid, the rest remains enforceable

Entire Agreement: These Terms override previous versions or agreements

Assignment: You may not transfer your rights; we may do so as needed
